The purported trump –up charges as alleged by Imo State House of Assembly leading to the impeachment of Imo state Deputy Governor Prince Eze Madumere is currently being challenged at a High Court sitting at Owerri Imo state capital. On Monday 13th of August, 2018, Ken Njemanze SAN the led Counsel to Imo State Deputy Governor during the gearing of the case queried the role being played the Attorney general and Commissioner for Justice, Honourable Milletus Nlemadim who he said was present on the July 30th, 2018 court sitting when Presiding Justice Benjamin Iheka Ordered that Imo state Chief Judge , Honourable Justice Pascal Nnadi , Hon. Ach Ihim , the Speaker Imo State House of Assembly, members of the 7-man Panel of inquiry and other members of the Imo state House of the Assembly be restrained from carrying out the purported impeachment of Prince Eze Madumere which was issued in the morning hours of the 30th August, 2008. But in a twist about 6-hours later members of the Imo state House of Assembly carried out Impeachment of the Deputy Governor Prince Eze Madumere an action anti the Order of the High Court.
www.towncrier.ng in its findings discovered that the Attorney General and Commissioner For Justice Milletus Nlemadim was abashed for his inaction in stopping the impeachment of the Deputy Governor since he has knowledge of the law and for being present at the Court sitting when the Order was issued. Ken Njemanze is challenging the allegation of constitutional breach in the impeachment procedure against the Deputy Governor Prince Eze Madumere. As the Court was told that “I am disappointed the Attorney General, Honourable Milletus Nlemadim who should know the law and advice the House Of Assembly appropriately but flagrantly allowed the House to do the wrong thing, thereby disobeying the Orders of the court. It is very unfortunate that he as in court and allowed such illegality.”
The leading counsel to the Deputy Governor, Ken Njemanze SAN narrated to the court how he had served the parties in the case which is an Ex Parte Motion except 4-8 respondents who are members of the 7-man Panel of Inquiry whose point addresses were not properly known so he applied for substituted service through the Chief Judge of Imo state. And the case was adjoined to Monday 20th August, 2018 for continuation of hearing on the substantive matter.
