All Progressives Congress, APC, in Rivers State supporters have been thrown into jubilation as Court of Appeal, Port Harcourt, today, January 20, strikes out the judgement of a Federal High Court that disqualified Tonye Cole its Governorship candidate.
Cole had filed an appeal to challenge the judgment of the Federal High of the Court, Port Harcourt presided over by Justice Emmanuel Obile that disqualified him on the grounds that he has dual citizenship and that the party’s primary that produced him as a candidate was not monitored by the Independent National Electoral Commission, INEC.
Justice Olabode Adegbehingbe who read the unanimous judgement said it was not the fault of the APC that INEC did not monitor the party’s primaries.
It would be recalled that Tonye Cole has going in and out of Court based on several cases instituted against his candidacy as APC Governorship flag bearer but has so far won at the Court of second instance.
Meanwhile, the Rivers Government has instituted a criminal case against him, Chibuike Rotimi Amaechi, former Governor of the state, immediate past Minister of Transportation and him, Sahara Energy limited and Augustine Wokocha, a former Commissioner for Power on the allegation that they illegally sold state assets.
