The Appeal court sitting at Port Harcourt judicial Division on Monday 15th of October 2018, asked all the parties involved in the case brought before it by Ojukaiye Flag- Amachree requesting to be joined in the suit 23 LGA delegates aspirants belonging to All progressive congress – APC brought before Justice Chinwendu Nworgu.
When the matter came up on Monday 15th of October 2018 for the adoption of motion papers from all the parties, Justice Isaiah Akuju before adjoining the case to October, 22nd 2018 told all the parties “to be law abiding and avoid anything that will hamper its proceeding and decision pending the determination of the supreme court on the same matter.”
The Comrade Peter Odike led 23 LGA delegates aspirants had approached the supreme court of Nigeria on the issue of stay of Execution granted to APC on June 21, 2018. While on Wednesday 10th of October 2018. Justice Chinwendu Nworgu of port Harcourt High court had in a judgment set aside all the Congress held by All progressive congress – APC on May 19th, 20th and 21st 2018.
The judgment is voided all action took by the All progressive congress that threw up Architect Tonye Dele Cole as Governorship candidate of APC in Rivers state. Even all other candidates that emerged as 32 state House of Assembly candidates, 13, Federal House of Representative candidates and 3 senatorial candidates that made Rivers south East , Ambassador Oji Ngofar, River west – Honorable Asita O. Asita And incumbent senator Andrew Uchendu to emerge as candidates to be put on hold until the determination of the matter before supreme court while Ojukaiye Flag Amachree led APC.
APC in Rivers state is also challenging the jurisdiction of justice Chinwendu Nworgu to entertain the case of which judgment had already been delivered on Wednesday October, 10th 2018. As it stand today, in the eye of the law, Rivers state APC has been restricted by court of Appeal from taking further action such as submitting list of elected candidates from the indirect primaries held in the month of September, 2018 as doing so will jeopardize the outcome of the decision of the supreme court and that of court of Appeal sitting at Port Harcourt.
